Terms of Service

1. Acceptance of Terms

By downloading or using the ULeveling mobile application (the “App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the App. These Terms form a binding agreement between you and the providers of ULeveling (referred to as “we”, “us”, or “our”). You also agree to our Privacy Policy, which describes how we collect and use your information.

2. Eligibility

Minimum Age

You must be at least 13 years old to create an account and use ULeveling. We do not knowingly allow children under 13 to use the App. If you are between 13 and 17 years old, you should review these Terms with a parent or guardian to ensure they understand and agree to them.

Account Registration

The App uses Sign in with Apple for authentication. You are responsible for maintaining the confidentiality of your Apple ID and for any activity that occurs under your account. You agree to provide accurate, current information (such as your age and any profile details) and update it as needed.

3. Subscription and In-App Purchases

• Free Trial: New users are granted a free trial period of 3 days. During this trial, you can use the App without charge. The trial begins once you activate it and will automatically convert to a paid subscription unless canceled at least 24 hours before the trial ends.
• Subscription Plans: We offer a monthly plan and a yearly plan, both of which unlock full access to the App. Prices are displayed in the App at the time of purchase. By subscribing, you authorize Apple (via the App Store) to charge the subscription fee to your provided payment method on a recurring basis.
• Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle (monthly or yearly) unless you cancel at least 24 hours before the current period ends. Your Apple App Store account will be charged for renewal within 24 hours prior to the end of the current period, at the price of the plan you selected.
• Managing & Canceling Subscription: You can cancel your subscription at any time via your Apple ID Account Settings on your device. Deleting your ULeveling account or the App will not automatically cancel your subscription—you must actively cancel through Apple to stop future charges.
• Free Trial Conversion: If you do not cancel before the 3-day free trial ends, your account will be rolled into a paid subscription and your payment method will be charged. Any unused portion of a free trial is forfeited if you purchase a subscription before the trial period ends.
• No Refunds: All charges and subscriptions are handled through Apple’s App Store. We do not provide refunds or credits for partial subscription periods, unless required by law. Any refund requests must be made through Apple’s App Store support.
• Changes to Fees: Subscription prices and offerings may change over time. If pricing changes for your plan, we will notify you in advance. Price changes will take effect at the start of the next subscription period following the change. If you do not agree to a price change, you must cancel your subscription before the change takes effect.

4. License Grant and App Use

Subject to your compliance with these Terms and payment of any applicable fees, we grant you a personal, non-transferable, non-exclusive, revocable license to use the ULeveling App on your device for your own personal development purposes. You agree not to use the App for any commercial purpose or resell any aspect of the App.

• Attempt to copy, modify, decompile, reverse-engineer, or extract the source code of the App, except as permitted by law.
• Use the App in any unlawful way or for any unlawful purpose, or in any manner that interferes with or disrupts the App’s functionality or servers.
• Circumvent or attempt to circumvent any subscription requirements, security features, or content protections in the App.
• Input or transmit any content that is illegal, harmful, hateful, harassing, defamatory, or violates any person’s rights (including intellectual property or privacy rights).

5. User Content and Data

• Your Content: You retain ownership of the personal data and content you provide in the App. We do not claim ownership of your raw personal content. You grant us a license to use, process, and display your content solely for the purpose of providing and improving the ULeveling service.
• AI Generation: We may transmit your input to our third-party AI partner (OpenAI) to generate personalized content. This data transfer is handled per our Privacy Policy.
• Reliability of Content: All content is for personal development and not professional advice. Always use discretion and consult a qualified professional for significant decisions.
• User Responsibility: You are responsible for any content you input. Do not share highly sensitive information like credit card numbers or SSNs.
• Account Deletion: You can delete your account and data at any time from the App’s Settings. Deleting your account does not cancel subscriptions—you must cancel via Apple.

6. Privacy and Data Handling

• We collect personal information you provide to personalize your experience.
• We store data securely using trusted third-party services (e.g., Supabase).
• We share data with third parties only to operate features (e.g., OpenAI, Apple systems).
• We do not sell your personal data for advertising or marketing.

7. Intellectual Property

All intellectual property rights in the App and its non-user content are owned by us or our licensors. You agree not to reproduce or create derivative works without permission. ULeveling and related logos are trademarks/service marks.

8. In-App Notifications and Communications

The App may send in-app or push notifications for updates. You can manage push preferences in your device settings. We may also send service-related emails but not marketing emails without consent. For support, visit ulevel.app/contact-support.

9. Termination of Service

By You

You may stop using ULeveling at any time. Deleting your account does not cancel subscriptions—you must cancel via Apple.

By Us

We may suspend or terminate access if you violate Terms, subscription lapses, or we discontinue the App.

Effect of Termination

Upon termination, your rights to use the App cease immediately. Sections that should survive will continue to apply.

10. Disclaimer of Warranties

ULeveling is provided “AS IS” and “AS AVAILABLE”. We disclaim all warranties to the fullest extent permitted by law. We do not guarantee:

• The App will meet your expectations or achieve specific results.
• The App will be uninterrupted, timely, secure, or error-free.
• Any content obtained through the App will be accurate or reliable.

11. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, consequential, incidental, or special damages. Our aggregate liability is limited to the fees you paid in the past 12 months, or $0 if none.

12. Indemnification

You agree to defend and indemnify ULeveling’s team from any claims arising from your use of the App or violation of these Terms:

• Your use and access of the App
• Your violation of these Terms
• Your violation of third-party rights
• Any claim that your content caused damage to a third party

13. Changes to the Terms

We may update these Terms occasionally. Significant changes will be communicated via in-app notice or email, and we will update the “Last updated” date. Continued use after changes constitutes acceptance. If you disagree, stop using the App and cancel subscriptions.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of California, USA. Disputes will be resolved in California courts unless otherwise required by law. We reserve the right to seek injunctive relief in any jurisdiction.
